NZPPA has spent over 18 months battling to get access to MBIE’s training and resource material on the Holidays Act 2003 (via a OIA complaint to the Ombudsman). It took a judge to get MBIE to provide this material as they used every delaying tactic to try and stop NZPPA to get access.
NZPPA wants to share this with all employers and payroll professionals not just our members so everyone can get as much information to help with the nightmare that is the Holidays Act 2003. We see this is the best approach for the public good.
NZPPA is not stating this information will give you all the answers “Far from it” but it does give a lot of background information that may help.
NZPPA believes if MBIE can state an employer has got the Holidays Act wrong and threaten them with legal action they then must know how the employer can get the act right. MBIE please tell us how to get it right! We want leadership not further indecision and confusion?
NZPPA would rather see MBIE take a stand and make some decisions on areas of the act that are causing the issues for payroll, payroll suppliers and employers. If this does get challenged great as this will get it out in the open and into the courts to resolve for all.
There were 6 documents released under the OIA complaint that have been received by NZPPA. There are still some redacted parts based on legal opinion that we still cannot access but we have most of the content now. We have made the two Holiday Act Resource Manuals available to all. The other 4 documents are available to our members through the NZPPA members only area of the NZPPA website.

Hi, Just wondering about the version dates… Version 4.8 has a last updated date of 15/5/2014, where as V4.6 has a last updated date of 4/7/2014 (so the earlier version has been updated after the later version)? So which one is later?
Also I bet they have updated it since then… did they give you the version applicable at the time of your request – or the current version?
It has taken 18 months just to get this and that was a nightmare, we will be making another request for updated manuals expected date 2020!
Hi David, Fiona has a very good point. Should we be referring to the latest numbered version, or the latest dated version? This is just another example of the incompetence of a department that is victimizing so many companies in order to justify its existence. By far the majority of New Zealand companies have excellent relations with their staff, and have policies in place to ensure that all staff are treated fairly, and indeed often go out of their way to be very generous to their employees. But a complaint from one disgruntled employee will result in an MBIE audit that often stretches the company’s resources and finances to breaking point. All power to the NZPPA in its battle against this bureaucratic bullying monster.
